    Medical Records & Items

    This application & warrant are used when you need to obtain patient medical records from a medical facility. If you have reason to believe that the facility still possesses a biological specimen such as blood, include the highlighted language regarding “items.” If you are only seeking records, you can remove the language about items and replace with “records.” Please note, most medical facilities hold their biological specimens for a very limited time so if you wish to seize these things, you will need to move quickly and communicate this to the reviewing attorney/judge. The language in this warrant DOES allow you to send seized specimens to FDLE or another lab for further analysis.

    Exigent Circumstances Phone Order

    This document is to be used when a life-threatening injury or danger (or escaped convict) required the IMMEDIATE issuance of a phone order to track the location of the phone holder. The emergency must have been so urgent that it could not wait until a judge could review the order. Under those circumstances, you may get the information from the phone company, but then you must follow up with this document within 48 hours of the emergency.

    This motion & order are used when you know you will need more than the standard ten (10) days to produce your warrant return to the Court. This should be completed immediately (at the time you apply for your warrant) when issuing a warrant to any cell phone company, social media company, or any organization with a physical location outside of Florida. Other situations should be considered on a case by case basis. If you did not realize that you would need more than ten days to complete your return, submit this motion as soon as you are aware (and within the ten day period).
